Procedures for Change of Representative Office Address
Foreign Traders The registered operation address of the Office is clearly stated on the License granted. In case a foreign trader moves to a new address, he/she must carry out procedures for adjusting the representative office license within 60 days from the date of change. Following, the ABA Law guides the procedure for changing the address of a foreign representative office as follows:
Legal basis
Decree 07/2016/ND-CP; Circular 11/2016/TT-BCT. 1. Cases in which it is compulsory to adjust the License for Establishment of a Representative Office “Cite in Article 15 of Decree No. 07/2016/ND-CP” Foreign traders must carry out procedures for adjusting the License to set up a representative office. representative, branch establishment license in the following cases:
➥ Change the name or address of the foreign trader's head office.
➥ Changes in the operation contents of the foreign trader are directly related to the operation contents of the branch in Vietnam.
➥ Change of head of Representative Office, Branch.
➥ Change the name of Representative Office, Branch. – Change the operation content of Representative Offices and Branches.
➥ Changing the address of a representative office in a province or city directly under the Central Government or in a geographical area under the management of a Management Board.
➥ Change of branch office address.

Procedures for changing the address of a representative office license
a) In case of change of address of a foreign trader
- Adjustment application form (regulatory form – Foreign trader to sign).
- An adjusted copy of the Business License or equivalent document (must be stamped by the Ministry of Foreign Affairs, consular legalized and notarized translation into Vietnamese).
- Original License for establishment of representative office.
b) In case of change of representative office address
- Adjustment application form (regulatory form – Foreign trader to sign).
- Office lease contract or memorandum of understanding has been signed.
- Original License for establishment of representative office.
Note: In case the registered address is located in an apartment building or apartments, it must be accompanied by a written certification of the building or a document proving that the proposed address is allowed to conduct commercial activities. (According to Article 6 – Law on Housing 2014 and Clause 7 Article 80 Decree 99/2015/ND-CP stipulating a number of articles in Law on Housing).
In case of change of address to another province/city, additional papers or documents to fulfill tax obligations must be provided at the tax authority of the place of relocation.
